It is the greatest promise of our time. Yet, when the great techno-cultural icons of our time get on stages around the world to discuss AI, the picture is not always optimistic. AI poses some truly enigmatic concerns. Some of the more existential problems have taken centre-stage, concerning the direct risk to humanity of the literally inconceivable potential of self-developing artificial intelligence. Sam Harris, Elon Musk, Max Tegmark and Nick Bostrom all warn of the risk that an AI which can improve itself could come to annihilate modern society as the consequence of a poorly-stated program or neglectful management.

For instance, given some task to fulfill, the AI might work out that the easiest way to complete it is to turn the entire planet into a research lab, removing all functions not related to the goal, including all biological life — and doing this with all the emotional investment of a construction crew removing ant hills to make way for a new highway.

The prospect of mass annihilation at the hands of superpowerful computers is terrifying, all the more so for originating in something as human as faulty programming or sloppy routines. A multitude of movies and books depict menacing cyberantagonists creating hopeless dystopias, and this may strike you as the greatest moral risk we face in continuing to develop artificial intelligence.

I happen to think that this is not the case, and that our new technology might yield even worse states of affairs. The greatest ethical risks in fact concern not what artificial intelligences might do to us, but what we might do to them.

If we develop machines with consciousness, with the ability both to think and to feel , then this will necessitate an ethics for AI, as opposed to one merely of AI. Eventually, we will have to start doing right by our computer programs, who will soon fulfill whatever criteria are required to be considered moral subjects. There are extensive arguments readily available for a positive answer to the question of whether computers could actually become conscious, which I can only summarize here.

Additionally, when given legal rights, artificial consciousness can be a threat to humans because those who develop these machines might misuse such technology for personal gain. Concerning criminal responsibility, under the law, a robot cannot be held accountable. Rather, the entity behind it will be held responsible because the decision-making process is not autonomous; the robot operates with guided instruction from humans Conitzer et al.

Additionally, artificial consciousness displayed by artificial machines does not have a free will to push humans to commit an illegal action; therefore, it cannot be subjected to negligence or recklessness to be subjected to legal damages. When defining laws to determine the legality of artificial intelligence of devices, it is not easy to justify why they need legal rights because artificial consciousness cannot be real in a computer system.

For example, when a self-driven car causes an accident, the manufacturer will take all the blame. This explains why artificial intelligent codes ensure that certain rules are applied according to the existing laws. The law does not recognize artificial consciousness. Real consciousness of human beings includes self-determination and autonomy, which artificial intelligence lacks.

What distinguishes humans from other things is their consciousness. Having the ability to understand rules and showing the intention to comply by them makes humans distinct Holder et al. Human beings have a higher capacity to interpret information and situation, which is different from devices; therefore, rights and obligation based on legal personality, cannot arise. The existing laws well define the question of holding computerized devices accountable because several people design artificial intelligence systems.

The main question is who has copyright protection, and who should be held responsible for infringements of rights and damages caused as a result of the system functions. Therefore, imposing rights and responsibility on a system with artificial consciousness can be difficult since they have certain limitations, such as emotions and self-awareness, which cannot help them in determining their actions.

Artificial consciousness found on devices does not make them equal to humans, and thus, they should not be granted similar rights to humans. Laws already exist to guide human-like artificial consciousness because as much as artificial intelligent machines possess artificial consciousness; this is not enough to equate machines with humans. Understanding our relationship with devices should not be exaggerated in a way that might equate us to robots.
